This in an ongoing problem and getting worse year on year. Over grown leylandii trees and thorn bushes are encroaching from the Garden of number 91 Lincoln road on to the public footpath of Millfield Road. The path is obstructed by 85%. Branches and brambles at eye level, debris, rubbish and dead vermin in the lower areas of the bushes and trees. The fallen needles and leaves are also blocking the drains in the road. The path is unpassable without stepping in to the road or being struck by stray branches and brambles. There is an unacceptable risk of injury to anyone using the path. It my understanding that the County Council acting as the Highway Authority has a statutory duty to maintain public footpaths in a safe condition and fit for the type of traffic which is ordinarily expected to use it. This stretch of footpath could not be described as in a ‘safe condition’. I fully understand that the issues are generated from the occupier of 91 Lincoln Road. However, as this property is neighbouring the public highway it would suggest any dispute about responsibility for maintenance of the leylandii trees and the associated hazards is between the occupier of 91 Lincoln Road and Lincolnshire County Council. I trust that Lincolnshire County Council Highways will review this matter with a view to ensuring that the public footpath is restored to a safe condition and fit for purpose.
