We are sorry but we are not taking immediate action with this report. We have checked the title to this property and it specifically states that only the cellar is included within the area numbered 3 in blue on the title plan. Therefore you only own this underground structure – you do not own the surface of the land which is public highway. The whole of the Butter Market area is highway and therefore you have no rights or ownership of it and cannot fence off an area to prevent vehicles from using it. The openings and structures of cellars are specifically covered in sections 179 and 180 of the Highways Act 1980 and s180 states:- (6)The following, namely— (a)every vault, arch and cellar under a street, (b)every opening in the surface of any street into any such vault, arch or cellar, (c)every door or covering to any such opening, (d)every cellar-head, grating, light and coal hole in the surface of a street, and (e)all landings, flags or stones of the street by which any of the above are supported, shall be kept in good condition and repair by the owner or occupier of the vault, arch or cellar, or of the premises to which it belongs. Therefore it is clear that the responsibility for the structure and support of the cellar is yours. Thank you for reporting this matter.
