Pothole on pavement/verge problem

Personal Injury Claim - Uneven footpath - incident on 12.11.21 - Opposite Moy Park outside Tennis Courts near Bus shelter on the left-hand side of the footpath
Please describe how the incident occurred: I was walking back from Selecta tyre centre. Having a tyre fitted. I didn't want to wait so walking back down the footpath towards North Parade it was reasonably busy, people walking their dogs, pushchairs and cycles in the cycle lane, so I kept to the left of the pedestrian area of the path. As I walked in flat boots, I was keeping a steady pace and approaching a lady coming the other way. I felt a dip in the path and it made my ankle go over to the left, I lost my balance falling both forward, and sideways and heard my ankle snap. The lady came to my help and asked if she could assist me back on my feet but I was in too much pain and felt sick and dizzy from the pain. I managed to turn over from face down to a sitting position but could not get back on my feet. A young couple also witnessed the incident and came to help. I managed to get up after almost 10 minutes, but couldn't walk so I hopped to the bus shelter seat and rang a friend to pick me up. The edge of the path is not straight or has any edging between the grass and tarmac of the path and it falls away to a grass verge by about an inch, there is not any path curb stones and in some areas the path extends into the verge further than other areas. Therefore you have no clear indication where the path edge ends, when you keep your distance in passing other walkers.

  • We are sorry but we are not taking immediate action with this report because at this section, the footway intentionally narrows to allow for a larger section of the grassed verge. As such, this section of the footway requires no further works as this is the intended design. We are sorry that you had your fall. Thank you for reporting this matter.
