Sent to Lincolnshire County Council less than a minute later. Council ref: 413082.
No Traffic Regulation Order has been made by the Council to close this section of footway and accordingly this closure is illegal. Under the Highways Act 1980 para 56(1) parts (a) and (b), I serve notice upon the Lincolnshire County Highways Authority requiring the Authority to confirm that liability for the maintenance of the footway is their liability?

Ref 413082, this situation has been left unresolved for 5 year's or more. Pedestrians have to step into the highway to negotiate the metal sign.

We are sorry but we are not taking immediate action with this report. The footway is closed off for the safety of the public, the highway is still open, we would not normally raise a TRO to section off a dangerous part of the highway. Whilst we completely understand your frustrations about the closure of this part of the footway on Cowbit Road, the council has closed it off to keep the public safe. We would love to be able to repair and reopen the footway on Cowbit Road however, the fact remains that we cannot afford to spend upwards of £250,000 on 50m of pavement at this time. We do not have an unlimited budget to spend on road repairs, and so we can't do everything we want to at once; we have to prioritise our funding. Repairing this part of Cowbit Road's footpath now would take money directly out of pothole repairs, resurfacing, surface dressing and other schemes to keep road users safe. Thank you for reporting this matter.
