Footpath bank between Adjacent property 10 School Lane & Library

Sent to Lincolnshire County Council less than a minute later. Council ref: 429933.
Repeat of earlier report Council ref: 408841. Please note your previous reply "The surface water run off shown during periods of heavy rainfall from private land onto the public right of way." Did not include that their is a public drain pipe overflow from High Meadow road just inside 10 School Lane property directly behind the top of the bank map/photo location. The rain water flow is now steadily eroding the bank forming a gully that is sending loose stones down the public footpath that is frequently used by children, as the school is next door.

We are sorry having reviewed the additional information provided we are still not taking further action with this report. Whilst there are no significant safety concerns for those using the public right of way this matter is treated as a low priority. The surface water run off shown during periods of heavy rainfall from private land (customer images have been assessed) onto the public right of way which then may subsequently contribute towards the minor flooding of the library car park is also considered to be a private matter. Please note the highway drainage outfall pipe from the nearby estate road described is recorded as running beneath the public Right of Way into the land drainage within the nearby playing field Thank you for reporting this matter.

Your reply is incorrect in that it fails to mention that the highway drainage outfall pipe has a large rectangular inspection cover, 25% of which is on my land, (the rest is on the public footpath side). There is no surface water run-off from my land, it comes bubbling up from this cover, (photo is of this area from my land side, with the council fitted concrete slab and fence). This occurs every time there is heavy rain. It needs inspecting to check for a blockage. The second photo is of the public footpath bank that is being washed away down the path from the other side of the drain cover. The third photo is the length of the footpath down to the road where this overflow drain water was over 2” in depth today, and at the time the adjacent School was finishing and being heavily used by children and parents with push chairs. This is not satisfactory and is a hazard.

Great news, we’ve had a look at the issue and we have now passed to our Highways Officers for the team to assess what can be done to resolve the matter. We’ll let you know when the assessment has taken place.

We are once again reporting back that we are not acting further on this enquiry. There is no current evidence that the surface water pipe in the embankment referenced in our previous responses is publicly maintained. Regardless of its status we must reiterate once more that whilst the footpath is a public right of way the issue described and shown in the images is not considered a significant hazard to those using the footpath and is not being treated as a priority. Thank you for reporting this matter.
