Sent to Lincolnshire County Council less than a minute later. Council ref: 461960.

You will see from the attached image that I sent you a report on the situation of my previous report, and it was obviously overlooked as there was no further communication, and you stated that it is closed. I would have to say that the issue is still outstanding and needs resolution to avoid a serious or fatal accident involving pedestrians or cyclists on this route. I look forward to hearing from you.

  • Thank you for your enquiry. We acknowledge your concerns however, we will not be taking further action at this time. An officer has been to site and measured the footway in various places and whilst it is smaller than the original width of the footway, it is still legally wide enough for usage. Please feel free to re-report this issue if it worsens significantly. Thank you for reporting this matter.

  • I note that you say it is "legally wide enough for usage". However, on consulting your own website, (see quote below), I think you should reconsider your stance on this, especially considering the significant danger from heavy vehicles passing.

    Lincolnshire County Council website "Decision There is no minimum size for the classification of footways/pavements. The legal definition of a footway is: “a way comprised in a highway which also comprises a carriageway, being a way over which the public have a right of way on foot only”.

    The Disability Discrimination Act recommends that a minimum of 1200mm width of footway should be kept free of obstructions. Lincolnshire County Council seeks to adhere to this recommendation through maintenance, initial scheme design, enforcement, and development management. However this is not always possible due to the historic nature of footways in the County with many under the 1200mm minimum recommended width". There are no historic reasons why this cannot be undertaken.
