Sent to Lincolnshire County Council less than a minute later. Council ref: 471864.

A CRACK HAS APPEARED AT THE SIDE OF THE BRIDGE AT No 54 WEST BANKS ON THE ROAD SIDE. I REPORTED IT TO THE ENVIRONMENT AGENCY WHO ADVISED ME TO CONTACT YOU. THIS IS THE ONLY ACCESS TO MY PROPERTY.

  • Thanks for letting us know about the issue. Following investigation and confirmation from our floods and water team they have confirmed that this crack is located under the bridge structure which access’ the private property, this is the responsibility of the property owner to maintain as riparian owner. This information should be included on the property deeds. Thank you for reporting this matter.

  • Case 478269 - updated information. The bridge is not on my property deeds and legally I only have rights of access to my property. The Environment Agency informed me that a riparian owner is the owner of property (ie land) alongside a natural watercourse. Under common law a riparian owner possesses rights and responsibilities relating to the stretch of the watercourse which falls within the boundaries of their property. According to the EA, I am the riparian owner only for the riverbank that is part of my boundary. I am only responsible for maintenance up to half way across the section of watercourse that runs past my land. The person/Agency/Council on the opposite bank is responsible for the other half of the watercourse. I have no other way of accessing or exiting my property except over the bridge. Please reopen my case. Thank you.
