Sent to Lincolnshire County Council less than a minute later. Council ref: 2818197.
The dyke/ditch is very overgrown and full of debris. This area is extremely liable to flooding. National Highways have cleared the culvert on the A52 under Village Street/Allington Road, and clearance of this dyke/ditch would further contribute to preventing the flooding on Village Street/Allington Road.

This fault is not on the publicly maintainable highway. It is the responsibility of the adjacent landowner to maintain their dykes, ditches and culverts. We would suggest contacting your local Parish/Town Council who can raise this with the land owner. Thank you for reporting this matter.

It is noted that this has report has been closed as the dykes are not on publicly maintained highway. Given that the Parish Council have requested clarity in the ownership and purpose of the dykes for a number of years i.e. are they there for highway drainage in which case they Highway Authority has the responsibility for maintenance. Given the lack of gullies in the area it is reasonable to assume that the dykes may indeed be highway drainage assets. Given that any flooding due to the condition of the dykes affects the publicly maintained highway by flooding it means that the Highway Authority has a duty to fully investigate the matter and if it is their asset carry out the required maintenance or if it is a third party who has responsibility then given that the authority is also the LLFA then powers exist to enable the dykes owners to be required to maintain them. This is not a legal function of the Parish Council. Grateful for,your reinvestigation of this matter.

This fault is not on the publicly maintainable highway. It falls under Riparian Ownership and is the responsibility of the adjacent landowner to maintain their dykes, ditches and culverts. To find the owner of the land you could contact Land Registry at https://www.gov.uk/ government/ organisations/ land-registry Thank you for reporting this matter.
