Council ref: 4203990.

Overgrown tree

Updates

  • The area of the tree I am querying is the side that hangs over the drive/road outside the front of my property not the main highway. This was reported on my behalf after I emailed customer services.

  • State changed to: Investigating

  • Thanks for getting in touch with us. In this case, we’re not responsible for this issue. We have investigated the tree outside your property and it does not fall under Lincolnshire County Council's liability. The resident is the sole owner. To carry out works on this protected tree please contact North Kesteven District Council using this link: https://www.n-kesteven.gov.uk/ planning-building/ planning/ tree-protection-hedges/ tree-preservation-orders Thank you for reporting this matter.

State changed to: not the council's responsibility

Posted by Lincolnshire County Council at 09:21, Wed 11 June 2025

  • Thank you. I have previously contact North Kesteven District Council about this matter and they have advised me to contact yourselves. I was also advised by the previous owner that the council had carried out previous pruning tasks as the tree is a joint responsibility. Therefore, that is why I sent the original email to customer services who then raised this. Please see below for my original correspondence to customer services.

    Good afternoon,

I am contacting you to ask for advice as to where I need to direct my query.

There is an oak tree at the front of my property that I believe is a shared responsibility between my property and the council/ highways. The tree has a tree preservation order on it and I have been instructed to contact yourselves by my local council.

Prior to purchasing my property nearly two years ago we were advised by the previous owner that the council looked after the tree and that they hadn’t needed to do anything with it. I would like to confirm if this the case as I believe that the tree requires some maintenance and I need to look into how I am to proceed.

If the maintenance is indeed my responsibility I would like advice about how I am able to gain permission under the terms of the preservation order to employ a tree surgeon to carry out this maintenance.

    Any advice appreciated.

    My property address is:

6 Heron Walk North Hykeham Lincoln Ln6 9TR
