Tree overhanging property

The tree now substantially overhangs the boundary of 40a Bourne Road, and during windy conditions, branches frequently fall onto the driveway. This poses a clear risk to vehicles parked below and potentially compromises the structural integrity of the garage roof.

  • Thank you for your recent enquiry regarding the tree at Bourne Road on the verge outside your property. Following a site visit, we will not be taking any action because the tree was found to not to be encroaching on the highway/footway. As the property owner you can trim back any branches that overhang your property. Thank you for reporting this matter.

  • Thank you for the response, but I must strongly challenge the conclusion that no action is needed.

    As can be seen in the attached photo, this is a large, mature tree on council-owned land with substantial overhang into my private property — specifically, above the area where my car is parked and directly adjacent to the garage.

    Branches fall regularly, and this poses a real and ongoing risk to property. If a large limb were to fall and cause damage, this would not be an unforeseeable incident — it would be the result of a known issue that the council has chosen not to address.

    While I understand I have the right to cut back branches to the boundary, the scale of the tree makes this impossible to do safely or legally without a qualified tree surgeon — and I do not believe residents should be left out of pocket simply to mitigate risk caused by council-owned trees.

    I’m therefore asking for the council to reconsider its position, particularly in light of risk to private property and the unfair burden being placed on a resident to resolve a public tree issue. I would much prefer to avoid having to escalate this further, but will do so if required.
