Overgrown trees

Sent to Lincolnshire County Council less than a minute later. Council ref: 2854905.
The trees and bushes are obstructing my house, the vegetation is falling on to our land and roof, creating drainage issues in our guttering and subsequently, we have had to employ contractors to clear the roof and repair our guttering system. Also, the boundary fencing is falling apart, with members of the public kicking the bottom panels. Please can you instruct your contractors to attend as soon as possible, this is the second time we have reported these issues and were told to check our deeds. However, this is a public right of way, owned and maintained by LCC, with clear LCC Signage either end of the PROW line.

We are sorry but we are not taking immediate action with this report because any responsibility for the tree will be determined by its condition and where it is rooted in respect to your home and the recognised width of the footpath. The county council is not responsible for hedges or fencing bounding the public footpath. These features would be the responsibility of the frontagers. You do not say or reveal from the one picture included that the tree is dangerous. It appears to be in full leaf consistent with your comment that leaves block your guttering. You do have the common law right to cut any overhang back to your boundary but should check with the district council that the individual tree is not subject to any statutory protection.
