Verge of entrance to property
Sent to Lincolnshire County Council less than a minute later. Council ref: 2858991.
As you can see from the photos Quickline has just dug holes and laid cabling for broadband/fibre optic cables. After they have finished work the ground has been left looking like the photos. When we spoke to them about leaving it like this, they said that this verge is the responsibility for the council to fix not theirs. So hence the message and fault report.

Dear Sir/Madam,
Further to my raising the issue of my damaged verge, a representative called Simon came out from the company that did the recent works and spoke to me about buying gravel to put over the damaged area.
This is not an appropriate remedy. North Road has farm traffic each day, including combine harvesters and lorries, which mount the verge to let cars pass as the street is not wide enough. Yes, it was made worse by the diggers, rollers, and other equipment from the recent works. But, please see the photo attached, which evidences the amount of verge mounting since the Quickline work was completed less than a week ago, as the white cover was only just added to the verge.
Putting gravel across this area is pointless for two reasons. Firstly, the lorries and tractors would disperse the material within a month, and secondly, stones would be sent flying and could cause damage or even injury to property or persons.
Please note that the new houses built in 2019, directly opposite my house, had their verges done properly with tarmac, and they are still holding strong. See the photo attached.
The reason I cannot perform this repair as the homeowner is that it is not my property, and I would be liable for any damage done to persons or property if it failed. Additionally, my insurance would not cover it, as it is not within my boundaries.
I have also attached a photo of a drain cover that is breaking up, as well as the T junction of North Road. For the council's attention.

We are sorry but we are not taking immediate action with this report because Quickline have advised they will attend to carry out remedials. Thank you for reporting this matter.

Quickline came out last week and wanted to put gravel down, and refused to fix the kerb properly, as it should be done. This is the same thing they tried back in October. As already described on numerous occasions, due to the large amount of farm traffic, the stones would be gone in about a month or so, and we would be back to square one. The kerb needs repairing properly, as per the photos of how the council made the new houses built in 2019 do it. This attempted bodge is not fit for purpose and is a health risk to walkers, cyclists, and other road users.

Thank you for the update. Quickline's contractor has contacted us since to explain the situation. Under the Specification for the Reinstatement of Highways (SROH) an undertaker such as Quickline allows them to reinstate to the condition of existing conditions. They are stating they offered to tie back tarmac back edge and install gravel however this was declined. Lincolnshire County Council cannot force Quickline or their contractor for a betterment i.e. installing a kerb like you have requested as this was not in place when there works took place. In terms of the works that took place opposite we believe that these works would have been installed by developer/builder as part of planning condition to build plots. Thank you for your statement. The person who came to my address ONLY OFFERED GRAVEL, they refused to tarmac. I do not know why they have lied to you, yet again. If you go back through the emails on this matter you can see the false promises already made and not fulfilled.
Therefore as you are unprepared to either resolve this issue by fixing my verge yourselves (as it is the councils verge which is damaged and unfit for purpose) or getting Quickline to do it, then you leave me with no alternative but to take this complaint to stage two of the formal complaints procedure and have your complaints manager review the entire process including emails. I hate wasting councils time but your failures have forced me to do so.

After taking legal advice this morning on this issue, I have been informed that, as you have now failed in your duty to resolve this issue within a reasonable time(over 6 months), I have the option to take this matter to the Magistrates' Court under section 56 of the Highways Act 1980. And as you've already agreed in writing that there is an issue and the highway is not acceptable in its current condition, then my chances of success are above 51% I have been advised to write to the CEO of the council as well as move the complaint to the next stage, which is the complaints manager of the council's own procedure. Before taking the above action, I wanted to give you one final opportunity to confirm in writing that you will fix this Highway issue within 10 working days of today. If you do this by the close of business on the 12th of May, I will not send this issue to the complaints manager and the council's CEO.
