I am submitting this formal complaint regarding the persistent flooding and consequent obstruction of the access route to Welton St Mary’s Primary School. The route has become impassable, directly impeding children’s ability to attend school safely.
Under the Highways Act 1980, the council has a statutory duty to maintain highways in a condition that is safe and passable for all users. Furthermore, pursuant to the Education Act 1996, local authorities are responsible for ensuring that children have safe access to education. The current failure to address the flooding constitutes a breach of these obligations and exposes the council to potential liability should harm occur.
The situation presents:
- A clear risk to child safety, as families are forced to attempt unsafe diversions. - Children are attending school drenched, simply because they must wade through standing water after the slightest rain. - A failure of statutory duty, as the highway is not being maintained in a usable condition. - A disruption of access to education.
I therefore require the council to:
1. Undertake immediate remedial works to restore safe access. 2. Provide a long-term measures to prevent recurrence. 3. Confirm the timescale within which these actions will be completed.
On previous occasions, the council’s reply has been that no standing water was observed during inspection. However, inspections carried out on dry days cannot capture the flooding that residents regularly endure after slight rainfall. After rainfall, the ground remains saturated for days. The photos illustrate how the narrowing path quickly floods, and the drain is visibly overwhelmed, unable to clear the standing water.
This matter requires urgent attention.

Great news, we’ve had a look at the issue and we have now passed to our Highways Officers for the team to assess what can be done to resolve the matter. We’ll let you know when the assessment has taken place.
