  • We are sorry but we are not taking immediate action with this report because That a neighbour's high hedges may detract from the enjoyment of your home is potentially an instance of antisocial behaviour. If you search 'high hedges legislation', then you will be alerted to the provisions of Part 8 of the Anti-social Behaviour Act 2003, which give powers to the district council to intervene in cases of this nature. The overhang of the hedge across your property is not however a concern for the highway authority, simply on the basis that the hedge outgrowth spans a public footpath before reaching your own boundary. The highway authority interest is properly confined to the extent to which any tree outgrowth / overgrowth affects the public in their use of the footpath. It is not considered that the conifer overgrowth currently obstructs the public footpath and no highway authority enforcement can be proposed in response to your concern.
